Terms and Conditions

1. Scope

These Terms and Conditions apply to every contract concluded between Avida Cosmetics e.U. ("we", "us", "the seller") and our customers via the Kabuto Katana online store at kabuto.at. Deviating conditions from the customer are not accepted unless we have expressly agreed to them in writing.

2. Offer and conclusion of contract

The presentation of products in our online store is a non-binding invitation to place an order. By clicking the "Buy now" button the customer makes a binding offer to conclude a purchase contract. We then send an automatic confirmation that the order has been received — this email does not yet constitute acceptance of the contract. The contract only comes into effect once we send a separate order confirmation or dispatch the goods.

3. Prices and shipping costs

All prices are quoted in euro and include the statutory VAT. Shipping costs are shown transparently in the checkout. We ship within Austria only.

4. Payment

We accept credit card, Apple Pay, Google Pay, Klarna, SOFORT, EPS and bank transfer. Payment is due immediately on conclusion of the contract.

5. Delivery

Orders received by 2:00 p.m. CET on business days are usually dispatched the same day. Delivery within Austria usually takes 1–3 working days. Pickup in Pichl bei Wels is available by arrangement. Detailed delivery times per region can be found on our Shipping page.

6. Right of withdrawal

Consumers have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which the consumer (or a third party nominated by them, other than the carrier) takes physical possession of the goods. To exercise the right of withdrawal the customer must inform us (Avida Cosmetics e.U., service@kabuto.at) by means of a clear statement. For opened cosmetic products that cannot be returned for hygiene reasons, the right of withdrawal is excluded in accordance with § 18 (1) 5 FAGG once the seal has been broken.

7. Warranty

Statutory warranty rights apply. In the event of a defect, please contact us at service@kabuto.at. We will arrange a replacement or refund as quickly as possible.

8. Liability

We are liable without limitation for damages arising from injury to life, body or health. For other damages we are liable only in cases of intent or gross negligence, unless mandatory statutory provisions of product liability law apply.

9. Data protection

We handle your personal data in accordance with our Privacy Policy and the provisions of the GDPR.

10. Applicable law and place of jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For contracts with consumers this choice of law only applies to the extent that the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence is not withdrawn. The place of jurisdiction for disputes with entrepreneurs is Vienna.
